An American woman may face up to ten years in prison after stabbing an Eritrean man in Germany.
According to the woman, she accidentally stabbed the man after he groped her backside at a train station in Kaiserslautern. After the woman was groped, she confronted the migrant and an argument ensued. At some point, the woman drew a knife and accidentally stabbed the man in the heart, resulting in his death.
The public prosecutor's office is now charging the woman with causing bodily harm resulting in death, which could see her facing up to ten years in prison. The prosecutors do not believe the stabbing was justified as self-defence.
Unfortunately, the self-defence laws in Germany do not cover extreme countermeasures. While someone who is unlawfully assaulted is permitted to use self-defence measures, there must not be an "extreme imbalance." In this case, it would seem as though there is an imbalance, since the threatened woman was armed.
The good news is that the prosecutors have not brought charges of manslaughter or intent to kill. Based on the CCTV footage, the stabbing appears to be unintentional.
The Germany-wide statistics on sexual violence are sobering. Since 2015, asylum-seekers have committed some 7,000 sexual assaults (ranging from groping to gang-rape). In 2023, there were 761 gang-rapes registered in Germany — almost two per day; 47.5 per cent of the suspects were foreigners.
It is understandable why women, like the one that was groped, may overreact in situations where they feel threatened by migrants. The threat of sexual violence is very real in Germany, and the government has shown extreme leniency towards migrant rapists.
In 2020, a 15-year-old girl was gang raped by 9 boys and men in a Hamburg park. Only one of them spent any time in jail. The rest received a suspended sentence. In a text message, the victim called one of her attackers a “disgraceful rapist pig” and was forced to apologise to her rapist and served a weekend in jail for the comment – more time than her rapist.
Most comments offer support to the woman groped, suggesting that it is easy for a man to overpower a woman in a situation like this. One user wrote, "Our politicians have allowed hundreds of thousands of men who view women as objects for them to use into western countries with predictable consequences. When people object or fight back they are prosecuted and jailed. I don't think politicians get the level of anger that is developing."
And another top comment said, "We all know that governments are letting these guys in without checks and we also know how they treat females!"
